Welcome to CAZA, operated by CAZA LLC (“CAZA,” “we,” “our,” or the “Platform”), a real estate marketplace for properties located in Honduras.
These Terms and Conditions of Use (“Terms”) govern access to and use of cazahn.com, its associated mobile applications, and the other services offered by CAZA (collectively, the “Services”). People may browse public listings without an account. By creating an account, becoming a Publisher, acting as a Designated Contact, purchasing a plan, or creating public content, the user confirms that they have read and accepted the current version of these Terms and CAZA's Privacy Policy.
1. Definitions
- User: anyone who accesses or uses the Services, with or without an account.
- Publisher: a user who completes CAZA's requirements to create and manage property listings.
- Listing: information, photographs, and other content relating to a property advertised on CAZA.
- Designated Contact: a user who voluntarily agrees to receive inquiries about another Publisher's listings.
- User Materials: text, photographs, documents, names, profiles, and any other content provided to CAZA.
2. CAZA's role
CAZA helps people discover properties and connect with interested parties, Publishers, and Designated Contacts. Unless expressly agreed in writing, CAZA is not a real estate agent, broker, legal or financial adviser, representative, or party to any sale, lease, or other real estate transaction.
CAZA does not receive deposits or property sale, purchase, or rental payments. Agreements take place outside the Platform under the participants' responsibility. The Platform does not provide legal, financial, or real estate advice.
3. Listings and results
Results may be organized according to the visible map area, location, selected filters, and other search-related criteria. A listing is not a CAZA recommendation, approval, certification, or guarantee. Its placement does not establish quality, legality, availability, or accuracy.
4. Eligibility, age, and registration
Properties may be browsed without an account. People under 18 may view this public content under the supervision of a parent or legal guardian, but they may not create an account.
A person must be at least 18 to create an account, become a Publisher, purchase a plan, publish a property, or act as a Designated Contact. Account creation requires an affirmative age declaration.
During publisher onboarding, CAZA requests the date of birth only to calculate eligibility and does not retain that date. A person who is at least 18 but not yet 21 must confirm full legal capacity to act on their own behalf. CAZA retains the result and, when applicable, the date, version, and language of that confirmation.
Users state that they will provide accurate, current, and complete information; will not impersonate anyone; will comply with applicable law; will protect their credentials; and will report unauthorized access. Accounts are personal and may not be shared or transferred without CAZA's authorization.
5. Public profiles and self-declared categories
Publishers may identify themselves as an Individual Publisher, Business, Real Estate Agency, or Developer. These categories and public names are self-declared. They do not verify a company's legal existence, tax registration, licenses, professional registrations, authority, experience, ownership, or authorization relating to a property.
Users state that they may lawfully use the name, image, trademark, or identity under which they present themselves and will not mislead others about affiliation or authority.
6. Optional identity verification
After completing age eligibility and phone verification, a user may optionally verify identity and age through Didit. This flow is separate from the onboarding age requirement. Approval only indicates completion of the personal checks configured by CAZA. It does not prove property ownership, authority to sell or rent, business representation, document authenticity, or any guaranteed transaction. The Privacy Policy will explain the processing of related data.
7. Responsibility for listings
The Publisher is responsible for all text, photographs, prices, locations, documents, references, and other materials. The Publisher states that they own or are sufficiently authorized to advertise the property; that information is accurate and not misleading; that the property is in Honduras; that they have rights to the materials and permissions from recognizable people; that they do not violate third-party rights or publish third-party data without permission; and that the listing complies with these Terms.
Displayed prices are asking prices supplied by the Publisher and may differ from the final transaction price.
8. License to User Materials
Users retain ownership of their Materials. By providing them, users grant CAZA LLC a non-exclusive, worldwide, royalty-free license to host, process, technically adapt, and display the content; operate, protect, and moderate the Platform; distribute the listing within CAZA; promote CAZA and its listings on websites, social media, campaigns, and promotional materials; and allow contracted providers to process the content solely for those purposes.
CAZA may crop or resize photographs but will not substantially alter prices or descriptions by attributing information the user did not provide. The license remains while the content is lawfully stored. After permanent content or account deletion, CAZA will cease new promotional uses and remove digital copies under its control within the applicable period, except where retention is legally required.
9. Price history and listing changes
CAZA may retain and display the public history of advertised prices, including dates and changes. This history does not necessarily reflect final sale or rental prices.
CAZA may limit changes after a listing is first activated. Broader corrections may be allowed during the first 48 hours; afterward, changes may be limited to price, negotiability, contacts, reducing exact location to approximate location, and authorized statuses. Corrections may return to moderation, and the last approved version may remain visible during review.
10. Documents, references, and SINAP
CAZA does not verify or guarantee deeds, titles, certificates, permits, property records, cadastral references, registrations, or other references. Visible documents or listings are not validation by CAZA.
When a Publisher supplies a reference, CAZA may help users copy it and open the official National Property Administration System (SINAP) website. CAZA is a private platform, does not represent or affiliate with the Property Institute or SINAP, and does not guarantee that a reference matches the property or proves ownership.
11. Designated Contacts
An eligible user may voluntarily grant general authorization to act as a Publisher's Designated Contact. The Publisher may manually select that person for the originating listing and future listings; the person is not automatically assigned to every listing.
While the assignment and consents remain valid, the contact's public name and phone number may be displayed. The contact may leave a listing or revoke authorization, and the Publisher may remove an assignment or end the relationship.
This feature does not create a power of attorney, agency, exclusivity, legal representation, or authority to sell, sign, receive deposits, or assume obligations. CAZA does not verify the Publisher's authority to appoint representatives.
12. Moderation, reporting, and blocking
CAZA may automatically review text, images, and other content to prevent illegal, offensive, misleading, or prohibited material. Users may report listings and profiles and block users through available features. CAZA may investigate, request corrections, limit visibility, remove content, and suspend or terminate accounts. Paying for a plan does not prevent moderation. Complaints may be sent to info@cazahn.com.
13. Prohibited use and content
Users may not publish false, fraudulent, or misleading content; impersonate others; use third-party trademarks or materials without permission; publish sexual or pornographic content, child exploitation, threats, harassment, violence, discrimination, or hate; reveal private data; offer illegal activity; send spam; introduce harmful code; interfere with security; scrape data through unauthorized automation; redistribute the catalog; or infringe third-party rights.
14. Personal safety
CAZA does not verify the background, financial capacity, or intentions of people who make contact about a listing. Users should take reasonable precautions before visits, meetings, payments, or negotiations, including confirming identities, communicating beforehand, meeting during daylight, informing a trusted person, avoiding meetings alone, and limiting unnecessary personal or financial data. In danger, users should contact the proper authorities or emergency services.
15. Plans, subscriptions, and payments
CAZA may require an active plan and available capacity to activate and maintain listings. Prices, currencies, periods, and benefits will be shown before purchase. Apple processes iOS purchases, Google Play processes Android purchases, and Stripe processes web portal payments.
Subscriptions may renew monthly or annually until canceled. Benefits continue through the paid period unless there is a refund, revocation, chargeback, or other valid loss of entitlement. Cancellation prevents future renewals but ordinarily does not end the paid period early. If payment fails or a plan expires, CAZA may pause affected listings until a valid entitlement exists again. Unused listing capacity does not roll over.
Except where required by law or a payment provider's policy, payments are non-refundable. Apple or Google handles mobile purchase requests through its own mechanisms. Stripe processes web payments. CAZA does not store complete payment card data.
16. Third-party services
CAZA may integrate external services for maps, location, communications, authentication, identity, moderation, storage, and payments, including WhatsApp, Google Maps, SINAP, Didit, Firebase, Microsoft Azure, Cloudflare, Apple, Google, and Stripe. Their own terms may apply. CAZA does not control their independent operation, without limiting CAZA's legal responsibilities for provider selection and data processing.
17. CAZA intellectual property
The Platform, design, software, trademarks, logos, and proprietary elements belong to CAZA LLC or its licensors. These Terms do not transfer ownership or permit trademark use outside the Services.
18. Feedback
Voluntary suggestions may be used to improve the Services without compensation, provided the use does not disclose personal data or confidential user content.
19. Intellectual property complaints
Anyone who believes protected material was used without permission may write to info@cazahn.com, identifying the material, listing, contact details, and basis of the claim. CAZA may request additional information.
20. Suspension and termination
CAZA may limit, suspend, or terminate an account or listing because of a breach, risk, fraud, abuse, legal order, or loss of eligibility. Where appropriate, CAZA may explain the reason and allow correction or support contact. Serious or repeated violations may result in permanent termination. Suspension is not deletion.
21. Account and data deletion
Users may request account deletion in the application and through CAZA's public web resource. CAZA may verify identity and will explain the effects. Once confirmed, access will be disabled, public content removed, associated data deleted within no more than 30 days, applicable provider deletion requested, social access revoked where appropriate, and completion confirmed by email.
Deleting an account does not automatically cancel Apple or Google subscriptions. Instructions will be provided before proceeding. CAZA will cancel future renewals it manages through Stripe when applicable.
CAZA may retain limited records required for tax or accounting duties, payment disputes, legal claims, fraud prevention, security, or valid orders. This does not keep an account active or allow ordinary or promotional use. Final periods will be described in the Privacy Policy.
22. Privacy and communications
CAZA processes information under its Privacy Policy, whose URL is pending. That policy will explain data, purposes, providers, transfers, retention, security, and rights. Users accept necessary communications concerning security, accounts, listings, contacts, moderation, plans, and service operation. Promotional messages will respect applicable preferences and rights.
23. Disclaimer of warranties
The Platform is provided “as is” and “as available” to the fullest extent permitted by law. CAZA does not guarantee a property's existence, availability, or legal status; a Publisher's ownership or authority; document authenticity; an interested person's legitimacy or financial capacity; a sale or rental outcome; or uninterrupted operation. Rights that cannot legally be limited remain unaffected.
24. Limitation of liability
To the fullest lawful extent, CAZA LLC is not liable for indirect, incidental, or consequential harm arising from interactions or transactions between users outside the Platform. The final monetary cap and exclusions remain subject to legal review.
25. Indemnification
To the extent permitted by law, users are responsible for claims arising from their content, infringement of third-party rights, illegal use, or violation of these Terms. The final scope remains subject to legal review.
26. Governing law and disputes
Governing law, courts, and any dispute resolution mechanism remain subject to confirmation and legal review, considering that CAZA LLC is organized in the United States and the Services will initially be available in Honduras and the United States. Mandatory user rights are not limited.
27. Changes to these Terms
CAZA may update these Terms for legal, operational, or product changes. Each version will state its number and effective date. For material changes, CAZA will notify users through reasonable means. Acceptance of the Publisher Rules is recorded once when the publisher profile is created or enabled and is not requested for each listing. If a legal change requires additional consent, CAZA will handle it separately.
28. General provisions
These Terms, the Privacy Policy, and specific purchase or contextual consent terms form the applicable agreement. If one provision is invalid, the others remain effective. Failure to enforce is not a waiver. Users may not assign rights or duties without authorization. Provisions that must survive will continue within legal limits. If translations differ, the Spanish version prevails.
